Tunisia: CFJ Describes Rejection of Appeal Against Abir Moussi’s Trial Referral as “Arbitrary Procedures” and Calls for Their Halt

The “Committee for Justice” *CFJ) has monitored developments in the case of Abir Moussi, leader of the Free Destourian Party in Tunisia. The Tunisian Court of Cassation has decided to reject the appeal filed against the decision to refer her to the criminal chamber of the Tunis Primary Court, based on Article 24 of Decree No. 54, issued on September 13, 2022.

On Tuesday, January 28, 2025, the Court of Cassation reviewed the appeal against the indictment chamber’s decision to refer Moussi to the criminal chamber in the case filed against her by the Electoral Authority. The case stems from statements she made during a press conference of the Free Destourian Party in December 2022, regarding its position on the parliamentary elections.

In a statement, Moussi’s defense team described the Court of Cassation’s decision as “dangerous,” noting that it exposes her to a prison sentence of up to 20 years simply for expressing her political opinion. The defense also expressed concerns over the implications of this decision on freedom of expression in Tunisia, arguing that Moussi’s trial is part of broader efforts to suppress opposition voices.

CFJ rejects these arbitrary measures against Abir Moussi, considering them a violation of her right to expression. The committee calls for an end to her prosecution and demands her immediate and unconditional release.
