On Friday, November 22, 2024, the Criminal Division of the Tunis Court of Appeal confirmed the initial ruling against the leader of the Free Constitutional Party, Aber Moussa, in a case brought against her by the electoral authority, based on Article 24 of Decree 54.
Lawyer Noufal Bouden, a member of Moussa’s defense team, announced that the court reduced the prison sentence from two years to one year and four months, emphasizing that the ruling is not final and can be appealed.
In a Facebook post, Bouden clarified that the case involves accusations of defaming the electoral authority and attributing false statements to a public official. The initial ruling, issued on August 5, 2024, sentenced Moussa to two years in prison.
For its part, CFJ rejects the sentence issued against the leader of the Free Constitutional Party, Aber Moussa, arguing that it constitutes a blatant violation of the right to freedom of opinion and expression, as guaranteed by international conventions. The committee calls for the annulment of the verdict, the cessation of all legal proceedings against Moussa, and her immediate release, asserting that such actions represent an unjustifiable restriction of fundamental freedoms.
