CFJ Condemns Re-Arrest of Ousainou and Amie Bojang Following High Court Acquittal

Banjul, The Gambia – 1st April 2026 

The Committee For Justice (CFJ) strongly condemns the re-arrest of Ousainou Bojang and Amie Bojang (the Bojang siblings) following their acquittal and court-ordered release by the High Court in connection with the alleged killing of police officers at Sukuta traffic lights. 

The High Court’s decision to acquit the siblings and order their immediate release is legally binding and must be respected by all state authorities, including The Gambia Police Force. Their re-arrest raises serious concerns regarding respect for the rule of law, judicial authority, and the protection of fundamental rights in The Gambia. 

The continued detention of individuals who have been declared innocent by a competent court may constitute arbitrary arrest and detention, in violation of the 1997 Constitution of The Gambia, as well as international human rights obligations under the International Covenant on Civil and Political Rights and the African Charter on Human and Peoples’ Rights. 

This development has sparked public outrage and led to protests, particularly among youth groups, civil society actors, and residents of Brufut, further highlighting the urgency of addressing this matter in a lawful and transparent manner. 

CFJ Calls for: 

  • The immediate and unconditional release of Ousainou Bojang and Amie Bojang;  
  • Full respect for the authority and decisions of the High Court;  
  • An independent investigation into the circumstances surrounding their re-arrest;  
  • Clear directives to all law enforcement agencies to comply strictly with court orders;  
  • Accountability for any officials responsible for violating the rights of the Bojang siblings.  

CFJ reiterates that adherence to the rule of law and respect for judicial independence are fundamental to maintaining justice, public trust, and democratic governance.
